I am aware that the use of the Club amenities and facilities, including the Club pool and the beach, is potentially dangerous and involves the risk of possible injury or death, and I have advised my guest(s) of the same. Notwithstanding the risks to myself and my guests, I and my guests voluntarily accept such risks and are voluntarily using the Club amenities and facilities notwithstanding such risks and agree to accept and assume any and all risks of injury, disability and/or death. I agree to release, indemnify and hold The Club at Henderson Beach Resort, LLC and Dunavant Gulf, LLC, and their agents, employees or affiliates harmless from any and all losses, claims, damages, liabilities or responsibility of harm resulting from me or my guests’ presence on the premises or use of the Club amenities and facilities, including with respect to any harm or damages to my guests and/or caused by guests from their actions or claims.

I will ensure that my guests comply with all Club rules and understand that if they fail to do so, the guest(s) will be removed from the premises and not allowed to return.
